1. Acceptance and scope
These Terms & Conditions (“Terms”) apply when you access or use the Waypoint Mobile RV Services (“Waypoint,” “we,” “us” or “our”) website. By using the website, you agree to these Terms. If you do not agree, do not use the website.
These Terms govern the website. Any diagnostic visit, repair, maintenance or other paid service is also governed by the estimate, work authorization, work order, invoice, warranty terms or other agreement provided for that work. If there is a conflict about paid services, the more specific written service agreement controls, subject to applicable law.
2. Your statutory rights are preserved
Nothing in these Terms excludes, waives or limits a right or remedy that cannot lawfully be excluded, waived or limited, including rights under Ontario’s Consumer Protection Act, 2002. Any limitation in these Terms applies only to the fullest extent permitted by law.
3. Enquiries are not bookings
The website provides information and a tool for preparing a text message. Sending an enquiry does not create a contract, reserve a time, authorize work or guarantee availability. An appointment is confirmed only when Waypoint communicates confirmation directly. Do not use the website for an emergency.
Waypoint provides scheduled mobile RV service and is not a roadside-assistance, towing or emergency-response provider. If there is immediate danger, a gas smell, fire, electrical hazard, medical emergency or unsafe roadside situation, move to safety and contact the appropriate emergency service.
4. Pricing, estimates and authorization
Website prices are in Canadian dollars and are general information current when posted. Unless expressly included, parts, materials, applicable taxes and travel beyond the stated service radius are additional. Availability, site conditions, diagnosis, parts pricing and the scope discovered on inspection may affect the final price.
A preliminary discussion is not a final quote. Waypoint will describe the authorized scope and pricing in an estimate, work authorization, work order or other direct communication. Additional work or a material change in price requires your authorization as required by applicable law. You are responsible for charges you authorize and for agreed cancellation, special-order or travel charges disclosed before they are incurred.
5. Customer responsibilities
When requesting or receiving service, you agree to:
- provide accurate contact, location, RV, symptom and ownership or authorization information;
- ensure Waypoint has lawful, timely and safe access to the RV and work area, including any campground or property permission;
- disclose known hazards, leaks, pest activity, prior modifications, third-party repairs and other facts that could affect diagnosis or safety;
- secure occupants and pets, keep the work area reasonably clear, and follow safety directions; and
- review the proposed scope, ask questions and give authorization only when you understand the work and price basis.
Waypoint may postpone or refuse work where access, weather, site rules or conditions create a safety, legal or technical concern.
6. Diagnosis, repairs and parts
RV systems can have hidden damage, intermittent faults, prior modifications and connected failures. A diagnostic visit is a professional assessment based on the symptoms, access and testing reasonably available at the time; it does not guarantee that every existing or future fault will be identified.
Repair timing depends on access, weather, parts availability and the condition of the RV. Waypoint may recommend additional testing, specialist work or replacement rather than repair. We will not knowingly perform work outside our qualifications or legal authority.
Any workmanship or parts warranty will be stated in the applicable invoice, work order or manufacturer’s terms. No website statement creates a warranty beyond those written terms or any warranty that applies by law.
7. Website information and availability
We aim to keep the website useful and accurate, but content may contain errors or become outdated. Website content is general information, not technical, safety or professional advice for your particular RV. Photos and examples are illustrative and do not promise a specific result.
The website is provided on an “as available” basis. To the fullest extent permitted by law, we do not promise uninterrupted access, error-free operation or that the website will be free of harmful components. You are responsible for using current device security and for independently verifying information before acting on it.
8. Limitation of website liability
To the fullest extent permitted by law, Waypoint will not be liable for indirect, incidental, special, exemplary or consequential loss arising solely from use of, inability to use, or reliance on this website, including loss of data, revenue, profits or opportunity.
This website limitation does not govern liability for paid service work where a separate service agreement applies. Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, breach of privacy obligations, or any other liability that cannot lawfully be limited.
9. Third-party services and links
The website may open your phone, text or email application or link to third-party websites. Those services are operated by others and have their own terms and privacy practices. We are not responsible for their content, availability or handling of information.
10. Acceptable use and intellectual property
You may use the website for lawful personal or business enquiries. You must not interfere with its operation, attempt unauthorized access, introduce malicious code, scrape it at an unreasonable rate, impersonate another person, submit unlawful or misleading content, or use it to infringe anyone’s rights.
The Waypoint name, logo, website design, copy, graphics and other original content are owned by or licensed to Waypoint and are protected by applicable intellectual-property laws. You may view and print reasonable excerpts for personal, non-commercial use, but may not reproduce, publish, sell or create derivative works without written permission.
11. Privacy
Our Privacy Policy explains how we handle personal information. It forms part of these Terms for website use.
12. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any consumer right to bring a claim elsewhere, the courts of Ontario will have jurisdiction over disputes relating to the website.
If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver.
13. Changes and contact
We may update these Terms as the website, services or law changes. The effective date at the top shows the latest revision. Changes apply when posted and do not retroactively change work already authorized unless both parties agree or the law requires it.
